Federal Court Costs Affidavits
We routinely prepare Costs Summaries, and responses to Costs Summaries on behalf of parties to Federal Court Proceedings where a gross-sum (or lump sum) costs order is sought.
There are many benefits to seeking costs on a gross sum basis in the Federal Court. Ordinarily, the cost of preparing the costs summary will be significantly less than the costs of preparing a bill for taxation. Additionally, the quantum of costs is usually determined by the presiding Judge or a Registrar much quicker than a taxation of a bill of costs.
Costs Summaries should be prepared in accordance with the Federal Court GPN-Costs Practice Notes. They can be prepared by the solicitor acting, or a costs lawyer or consultant, however there are benefits to our firm preparing the Costs Summary including (a) our costs are typically less than if the Costs Summary was prepared by a solicitor as we prepare Costs Summaries routinely and have fine-tuned our methodology; and (b) a Cost Summary prepared by an expert costs lawyer typically includes expert opinion evidence in support of the costs claimed which may be more likely to be adopted by the Court.

OUR FEES TO PREPARE A COSTS SUMMARY
Compared to the costs of preparing a bill of costs for taxation (approximately 8-10% of the professional fees drawn in the bill), our costs to prepare a costs summary affidavit are usually significantly less.
