Pricing - Ordered Costs Assessment Services (NSW)

Our pricing is structured to give solicitors and clients flexibility, transparency, and control over cost recovery risk. We offer tiered pricing based on the level of analysis, strategy, and advocacy required in each matter. All pricing below applies to NSW Costs Assessments on a party/party basis.

Costs Assessment Pricing – At a Glance

Our fees are calculated as a percentage of the professional fees claimed and are structured according to the level of preparation and advocacy required.

  • Basic Bill of Costs - 5%
    Filing compliance prepared from invoices or practice management data.

  • Standard Bill of Costs - 8%
    Enhanced preparation with selected file review to improve recoverability.

  • Strategic / Defended Costs Assessment – 11%
    Comprehensive, defended service.

  • Deferred Payment Option – available
    Pay our fees on completion of the assessment (additional loading applies).

 

Percentages are indicative only. Reduced or capped arrangements may be available for substantial matters.

Basic Bill of Costs
5% of professional fees claimed

Best Suited to:

  • Smaller or low-risk matters

  • Situations where filing compliance is the primary objective

  • Matters unlikely to attract substantive objections.

What's included:

  • Bill of Costs prepared from:

    • Tax invoices; or​

    • Exported data from practice management software.

  • Basic categorisation of professional fees and disbursements

  • Completion of the Costs Assessment Application form

  • Brief, high-level Summary of the Case.

What's not included:

  • Substantive file review

  • Strategic allocation or apportionment of items

  • Responses to objections (additional 4%)

  • Responses to assessor requisitions (billed on an hourly basis)

Standard Bill of Costs
8% of professional fees claimed

Best Suited to:

  • Most solicitor clients

  • Matters where recoverability is important but dispute risk is moderate

What's included:

  • Bill of Costs prepared from invoices, practice management software and selected file review

  • Proper itemisation and consolidation of attendances

  • Consideration of case and work undertaken and appropriate allocation of work to improve recoverability

  • Refined Summary of the Case addressing:

    • Complexity and scope of matter​

    • Volume of work undertaken

    • Procedural and conduct-based considerations

  • Completion of the Costs Assessment Application form

What's not included:

  • Drafting responses to objections (additional 4%)

  • Responses to assessor requisitions (billed on an hourly basis)

Strategic/Defended Costs Assessment
11% of professional fees claimed

Best Suited to:

  • Large or complex matters

  • Contested or high-risk assessments

  • Matters where recoverability is critical

What's included:

  • Comprehensive file review

  • Strategically prepared Bill of Costs drafted with assessment risk in mind

  • Detailed and persuasive Summary of the Case addressing:

    • Complexity, novelty, and importance of the matter 

    • Conduct of the parties

    • Submissions supporting the costs claimed

  • Consideration of case and work undertaken and appropriate allocation of work to maximise recoverability

  • Refined Summary of the Case addressing:

    • Complexity and scope of matter​

    • Volume of work undertaken

    • Procedural and conduct-based considerations

  • Completion of the Costs Assessment Application form

  • Responses to assessor requisitions and follow-up queries

What's not included:

  • Drafting responses to objections (additional 4%)

This is a fully defended service designed to maximise recoverability and minimise reductions

Deferred Payment Option (Pay Later)

​For eligible matters, we offer the option to defer our fees until completion of the costs assessment

Deferred payment attract a small additional loading, reflecting the time value of money and the risk assumed.

Deferred payment can be applied to any tier and may be bundled with objection work for a simplified, all-inclusive arrangement.

  • Fees are calculated as a percentage of the professional fees claimed in the Bill of Costs (exclusive of disbursements and Counsel fees).

  • Percentages shown may vary depending on:

    • Size and complexity of the matter​

    • Volume and condition of the file material

    • Urgency and assessment risk

 

Large Matters: For particularly substantial bills (generally exceeding $300,000), we are happy to discuss reduced or capped percentage arrangements.
